A recently settled CAN-SPAM complaint underlines the liability of companies for the actions of their affiliates.

Backed by a U.S. District Court in Nevada, the Federal Trade Commission (FTC) is requiring several porn sites keep detailed records on affiliate marketers.

The injunction order, filed in August, requires defendants obtain a name, address and working phone number for each affiliate and sub-affiliate who markets their content. Additionally, seven days before a campaign launches, affiliates must certify to the defendants how each e-mail address on their lists was obtained, together with details of the message content.

"It appears to me that the FTC is demanding better control of the affiliate marketing relationships," said spam policy expert Trevor Hughes. "And it seems to me there is plenty of room for just that.

Hughes is executive director of the Network Advertising Initiative (NAI). He describes the reliance of advertisers on their affiliates and sub-affiliates as "cascading trust relationships" which can easily run amok.

"I worry that it is an issue that is ripe for real problems for the marketplace," he said. "By the time the ad appears before the consumer, you may be three, four, eight or 10 steps away from the original advertiser."

The three defendants addressed in the injunction operate porn sites and infrastructure under various names. In addition to the injunction order, they paid a total $621,000 in fines. The judge issued a default judgment against a fourth defendant, an affiliate marketer named Paul Rose, who spammed on behalf of his co-defendants. The FTC charged the defendants' outbound e-mails violated CAN-SPAM and the agency's adult content labeling rules.

"The settlement will bar future violations and will require the marketers to monitor their affiliates to assure they are complying with federal laws, as well," the FTC noted in a statement. "While the affiliate sent many of the e-mails that allegedly violated federal law, under the CAN-SPAM Act all of the defendants are responsible for the e-mails, including the defendants who paid others to send the e-mails on their behalf."

AmEx limits keyword bidding

American Express has outlined some keyword bidding rules for their affiliates.

**American Express Terms and Conditions**

Effective today the below actions will be taken when affiliates have been found in violation of the American Express Terms and Conditions.

If an affiliate is found to be bidding on any of the American Express trademark names or renditions of, the following actions will be strictly enforced.

·1st Violation - Affiliate will receive a warning of the violation, where we will ask them to cease bidding within 24 hours. If the bidding is not removed within the allotted time frame the affiliate will be removed from the American Express Program.

·2nd Violation - If an affiliate has previously been notified of their non-compliant tactics and they are found to be bidding on trademark names again, they will be permanently removed from the American Express affiliate program.

American Express Search Policy:

We request that as a partner of American Express you abide by our terms and conditions and ask that you do not bid on our trademark names or renditions thereof. We police keyword bidding on the below terms daily, and in order to remain in compliance with our terms of service, we'd like to remind you of the following restrictions on keyword bidding. If you are found to be in violation of the American Express terms we will be forced to remove you from the program.

Please do not use any of our trademark names or renditions thereof in any part of the Title, Heading, Description, or Display URL of your ad.

Affiliates may not bid on any phrases containing "American Express" or "Amex" such as:

- American Express
- Amex
- American Express Charge Cards
- Amex Charge Cards
- Blue from American Express
- American Express One

Below is the complete excerpt from the American Express terms and conditions:

As a condition to your acceptance and participation in the Program, you shall not undertake or engage in the following practices, and any violation of this Section shall be deemed a material breach of this Agreement: (a) Use or otherwise incorporate the words "American Express", "Blue from American Express", "American Express Blue for Student Card", "American Express Gold Card", "American Express Credit Card for Students", "Gold Delta Skymiles Credit Card, American Express Platinum Cash Rebate Card, "Membership B@nking", "Gold Corporate Card for Small Business", "Corporate Optima Platinum Card" or variations or misspellings in the domain name(s) of your Site(s); (b) Modify or alter the American Express Site in any way; (c) Make any representations, either express or implied, or create an appearance that a visitor to your Site is visiting the American Express Site; e.g., "framing" the American Express Site (d) Use "American Express" or "Amex" as domain name, or portion thereof, unless expressly and explicitly authorized in writing by American Express; (e) Purchase "American Express" or "Amex" or other trademark or product name of American Express or variation or misspelling thereof as keywords, unless expressly and explicitly authorized in writing by American Express, or (f) During the term of or after the expiration or termination of this Agreement, use any mark, name or domain name of any type which is confusingly similar to "American Express" or "Amex" or other American Express trademarks.



Does this mean that you can't name the portion of your web page that includes American Express cards http://www.somethingsomething/amex ? What happens when a partner starts to market AmEx cards, e.g., The Citi Platinum American Express card? Whose keyword bidding rules trump whose?
